These Terms of Service ("Terms") govern your access to and use of the website obelowebstudio.com and the website design, hosting, and maintenance services (the "Services") provided by Obelo Web Studio ("Obelo", "we", "us"). By using the Site or subscribing to a plan, you agree to these Terms.
1. The Services
Obelo offers Website-as-a-Service plans that may include design and build, hosting, a domain, security updates, backups, and a set amount of content changes each month. The specific inclusions and limits of your plan are described on our Pricing page at the time you subscribe.
2. Plans, billing, and renewals
- Plans are billed monthly in advance and renew automatically until cancelled.
- Fees are stated exclusive of any applicable taxes, which will be added where required.
- If a payment fails, we may suspend the Services until the balance is cleared.
- Prices may change with at least 30 days' notice before your next renewal.
3. Cancellation
You may cancel at any time, effective at the end of your current billing period. We do not provide pro-rated refunds for partial months unless required by law. On cancellation, hosting for your site ends and we will provide an export of your site files and content on request within 30 days.
4. Your responsibilities
- Provide accurate account and billing information.
- Supply content and materials needed for us to deliver the Services.
- Ensure you have the rights to all text, images, and other materials you provide.
- Not use the Services for anything unlawful, harmful, deceptive, or infringing.
5. Content and intellectual property
You retain ownership of the content and brand materials you provide. Once your account is paid up to date, you own the final delivered design and page content for your website. Obelo retains ownership of its underlying tools, templates, components, and code libraries, and may reuse general know-how and non-client-specific elements on other projects.
6. Third-party services
The Services rely on third parties such as hosting providers, domain registrars, analytics, and payment processors. Their terms apply to their parts of the Services, and we are not responsible for outages or changes outside our control.
7. Service levels
We aim for high availability but do not guarantee uninterrupted or error-free Services. We perform maintenance and deploy updates as needed, and will give notice of significant planned downtime where practical.
8. Warranties and disclaimer
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Obelo's total liability arising out of or relating to the Services will not exceed the amount you paid us in the 3 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data.
10. Indemnity
You agree to indemnify Obelo against claims, losses, and expenses arising from content you provide or from your breach of these Terms.
11. Suspension and termination
We may suspend or terminate the Services if you breach these Terms, fail to pay, or use the Services in a way that risks harm to us or others. You may stop using the Services at any time as described in Section 3.
12. Changes to these Terms
We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date. Continued use of the Services after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Obelo Web Studio is established, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any disputes, subject to any mandatory consumer protections that apply to you.
